Homeowner Claims Bill of Rights

The Homeowner Claims Bills of Rights relates to the insurance claims process. Outlined in s. 627.7142 Florida Statutes, listed are your rights and responsibilities as a homeowners insurance policyholder.

  1. Your insurance company must send you an acknowledgement of your claim within 14 days after you submit it.
  2. Within 30 days of submitting a Proof of Loss Statement, your insurance company must send confirmation that your claim is either:
    1. Covered
    2. Partially Covered
    3. Denied
    4. Being Investigated
  3. Within 90 days of submitting a claim you should 
    1. Receive full payment 
    2. Payment of the undisputed portion of your claim or;
    3. A written denial 
  4.  If your claim is;
    1. Not denied and you do not receive full payment within 90 days
      1. Your insurance company must pay you full interest
  1. Caused by damage from a sinkhole and covered in your policy
    1. You may be eligible to participate in DFS’ Division of Consumer Services
  1. To resolve your disputed claim;
    1. You may be eligible to participate in mediation by DFS’ Division of Consumer Services
  2. Interest;
    1. Accrues on the date you filed your claim is paid and continues until your insurance company issues repayment
    2. Of the payment is due when the claim or undisputed portion is paid

your responsibilities

  1. File all claims directly with your insurance company
  2. Contact your insurance company before entering into a contract for repairs to ensure you adhere to the repair provisions included in your policy 
  3. Document necessary emergency repairs to prevent further damage before any repairs
    1. Keep damaged property 
    2. Keep receipts
    3. Take photos/video
  4. Read the contract that requires you to pay out-of-pocket expenses or additional fees based on percentage of insurance proceeds
  5. Confirm your contractor is licensed in Florida
    1. You can verify a contractor’s license for complaints by calling the Florida Department of Business and Professional Regulation

    2. Ask for references
    3. Require proof of insurance 
  6. Take precautions if the damage requires you to leave your home including;
    1. Securing your property
    2. Turning off gas, water, electricity
    3. Contacting insurance company and provide phone number
